Notes | Mid Sussex District Council Planning Agreements. Planning Agreements or Planning Obligations, currently known as s106 agreements (a reference to Section 106 of the Town and Country Planning Act 1990), are a mechanism that have been available to local authorities since 1932 that are used to make a development proposal acceptable in planning terms, that would not otherwise be acceptable. The common uses of planning agreements are to secure affordable housing or to secure financial contributions to provide infrastructure or affordable housing. A planning agrement can also: restrict the development or use of the land; require specified operations or activities to be carried out; require the land to be used in any specified way; or require a sum or sums to be paid to the authority on a specified date or dates or periodically.
